GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale, which define the rights and obligations of the parties to the distance selling contract, apply by right to the contractual relationships between Bewatched, a platform for selling vintage watches created and managed by DBG Investments registered in the Trade and Companies Register, and any Customer placing an order for products, on the website at www.bewatched.ch
Any order validated by the website entails the Customer's full and entire acceptance of these general terms and conditions. No special condition other than those of Bewatched can prevail over these general terms and conditions. Any contrary clause will therefore be unenforceable.
Bewatched reserves the right to modify these general terms and conditions at any time, with the modifications, however, only being applicable to orders validated after the update of said General Terms and Conditions.
PRICING POLICY
The prices of the Products sold on the Bewatched company website are indicated in euros, all taxes included, and are subject to changes during the year. It is, however, specified that the Products are billed at the price in force at the time of the validation of the order by the Customer.
Delivery charges are offered for deliveries WorldWide.
Furthermore, for all products delivered outside the European Union and outside the French overseas departments and territories, Bewatched draws the Customer's attention to the fact that customs duties or other local taxes or import duties or state taxes may be demanded, since the Customer is considered as the importer of the Products. These duties and taxes are not the responsibility of Bewatched. They will be the responsibility of the Customer and fall under their full responsibility, both in terms of declarations and payments to the authorities and/or competent bodies of the importing country. Bewatched advises the Customer to inquire about these aspects with the local authorities of the importing country.
DELIVERY POLICY
Products are delivered to the address indicated on the Customer's order form. Shipments outside Metropolitan France are possible (UK, Italy, Spain, Belgium, Switzerland, Luxembourg, Netherlands). The delivery time is a maximum of 10 working days from the receipt of payment (except for French overseas departments and territories and abroad).
All our products are shipped by La Poste with tracking or other transport companies. Reservations and special observations must be made within 48 hours. Although carrier insurance will be included, products travel at the risk of the recipient. For security reasons, the recipient's signature will be required upon receipt of the order. Any shipment to a post office box is therefore totally excluded.
ORDER POLICY
When the Customer places an order on the Bewatched website, it implies that they unreservedly accept these general terms and conditions of sale.
Automatic registration systems are considered as proof of the nature, content, and date of the order. Any Customer order is firm and definitive, from the moment it is received by Bewatched. Bewatched confirms the acceptance of its order to the Customer at the email address that they will have communicated. Bewatched reserves the right to cancel or refuse any order from a customer. The products remain the property of Bewatched until the order is completed and the Seller has finished processing the order. Payment is made before the delivery of the products.
Bewatched reserves the right to request a photocopy of the buyer's ID card, as well as proof of address for all orders, as part of the fight against fraudulent use of payment methods.
The Customer must check the order confirmation and immediately notify Bewatched of any error or anomaly. They may at any time contact Bewatched at the following address: contact@bewatched.ch, or from our Instagram: timetobewatched. Any subsequent modifications to the order must be made in writing and are only possible with the express agreement of Bewatched. The information provided by the buyer at the time of the order commits them. In case of error or incomplete details in the address of the recipient, the seller cannot be held responsible for the impossibility of delivering the product.
PAYMENT
Payment for purchases is made in cash on pick-up. Payments are also possible by credit cards (Visa, Mastercard, American Express) or by PayPal.
WITHDRAWAL / REFUND
Under Article L121-16 of the Consumer Code, the buyer has a period of 14 days from the receipt to return the product that does not suit them, without penalties, except for the return costs which will remain their responsibility. Also, for all products delivered outside the European Union and outside the French overseas departments and territories, Bewatched draws the Customer's attention to the fact that customs duties or other local taxes or import duties or state taxes may be demanded, since the Customer is considered as the importer of the Products. These duties and taxes do not fall within the scope of Bewatched. They will be the responsibility of the Customer and fall under their full responsibility, both in terms of declarations and payments to the authorities and/or competent bodies of the importing country.
To exercise their right of withdrawal, the Customer is invited to contact customer service, which will indicate the procedure to follow. Customer service can be contacted:
- by email at the following address contact@bewatched.ch No return will be accepted without prior agreement materialized by the allocation of a return number (RMA). The return number is valid for a period of 14 working days from the date of its allocation.
Any package sent without a return number will be systematically refused. The concerned product must be returned at the same time as the exercise of the right of withdrawal, that is to say, 14 days from the receipt of the product. The return costs are the responsibility of the Customer.
However, we draw your attention to the fact that the refund of watches can only occur if all the following conditions are met:
- The product must not have been worn, used, modified, deteriorated, nor have undergone any manipulation likely to prevent its resale in a reconditioned state.
- The product must be returned in its original packaging accompanied by the purchase invoice
Each returned watch will be subject to a diagnosis by our watchmaker who will confirm whether or not the conditions of point 1 mentioned above are respected. The refund will be deferred until the goods are received and will be made within a maximum period of 15 days after receipt of the return.
ITEM INFORMATION
Bewatched strives to describe and present the articles and products with the greatest accuracy. The documents associated with the products, in particular photographs and descriptions, are given for information purposes only and no technical or typographical error can give rise to claims and engage the responsibility of Bewatched. The photographs are non-contractual, colors, and details may be poorly rendered.
FORCE MAJEURE
None of the parties is held responsible towards the other party following a failure, delay or omission in the total or partial execution of an Order, provided that this failure originates or results from an event reasonably beyond the control of the defaulting party. In any case, force majeure cannot be invoked for a delay or a default in payment. If an event reasonably beyond the control of the Seller restricts the transport of the order, preventing the Seller from delivering the products according to the Order, the Seller may suspend all or part of the Order.
INTELLECTUAL PROPERTY
The site is the entire property of Bewatched, as well as all the rights related to it. It is protected by national laws and international treaties on copyright. Any reproduction, total or partial, is strictly prohibited. All texts, comments, works, illustrations, and images reproduced on the site www.bewatched.ch are reserved under copyright law as well as industrial property rights for the whole world. All rights related to the Site and the overall concept of the Company's activity, to their original and innovative character, in particular the intellectual property rights on the texts, literary and artistic creations, graphics (including photographs) and audiovisual works, computer developments, HTML developments and other works of the spirit and, more generally, all creations that may be protected by intellectual property law such as images, logos, layout, graphic charter, structure, ergonomics, color codes, typographies, font styles, basic graphic elements, the graphic organization of screens, page layout, background pages, the visual identity of the Site, belong to the Company or are regularly exploited by the latter, without limitation.
The Customer undertakes not to directly or indirectly harm Bewatched, the Site, or the rights of the Company.
PERSONAL DATA
The personal data that may be collected in the context of the sale are subject to processing for which Bewatched is responsible. This processing is intended for the management and commercial prospecting as well as the follow-up of the relationship with the client. The legitimate interest of the controller constitutes the legal basis for the processing. Personal data is reserved for the use of Bewatched and can only be transmitted to providers intervening to achieve the aforementioned purpose, offering products and services analogous to those related to the sale. The personal data collected and processed in this context will be kept for the entire duration necessary to achieve the aforementioned purpose. They may also be kept by the controller to fulfill its legal obligations. The controller implements appropriate measures to preserve the security and confidentiality of personal data and, in particular, to prevent them from being distorted, damaged, or unauthorized third parties having access to them. In accordance with the regulations relating to the protection of personal data, any natural person has the rights of access, rectification, deletion, portability, limitation, opposition for legitimate reasons and the right to define directives concerning the fate of their personal data after their death. These rights must be exercised with Bewatched at the following address: Bewatched, 44 rue Julien Bodereau, 72000 Le Mans.
COOKIES
The web page servers of the Site may place cookies on the User's computer, for the following purposes: personalization of the site, traffic analysis, memorization of login information, conservation of products selected by the User and added to their cart, carrying out advertising actions and statistics. To allow the proper functioning of the Payment Service Provider, additional cookies may be placed on the User's computer, for the following purposes: authentication, prevention and detection of fraud, security.
APPLICABLE LAW – DISPUTES
This contract is subject to French law. The French courts will have jurisdiction to rule on all disputes that may arise between the parties relating to its execution. Bewatched cannot be held responsible for damages of any kind, both material, immaterial or bodily, that could result from the malfunction or misuse of the marketed products. The same applies to possible changes in products resulting from the manufacturers. Bewatched's liability will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions that could have remained despite all the precautions taken in the presentation of the products. A French Commercial Court will be the only competent one, regardless of the delivery address or the mode of payment accepted."
